【线上云德】疫情期间律师说（一百五十二）┃《民法典》中人格权编亮点解读

自从2020年5月28日第十三届全国人大第三次会议正式通过《中华人民共和国民法典》以来，《民法典》受到全社会广泛的关注。作为具有中国法治建设里程碑意义的事件，《民法典》的颁布和实施，对于民众从事社会活动的影响不可谓不巨。

Since the third Session of the 13th National People's Congress officially adopted the Civil Code of the People's Republic of China on May 28, 2020, the Civil Code has attracted wide attention from the whole society. As a milestone in The rule of law construction in China, the promulgation and implementation of the Civil Code has a great impact on people's social activities.

新编纂的民法典共有七编，人格权编部分，在《民法总则》的基础上，以现实问题为导向修改、添加了部分条文。

The newly compiled civil Code has seven parts, including the rights of personality. Based on the General Provisions of the Civil Law, some provisions have been revised and added, which are oriented towards practical problems.

总的来说，人格权编主要的变化亮点包括：

第一、明确人格权不得放弃、转让或者继承；

第二、人格权受侵害时，六种请求权不收诉讼时效限制；

第三、主张违约责任时可同时要求精神损害赔偿；

第四、针对侵害人格权的行为人可申请行为禁令；

第五、明确禁止性骚扰，明确机关、企业、学校责任。

In general, the main highlights of the changes in the Rights of Personality include:

1.make clear that the right of personality shall not be waived, transferred or inherited;

2. when the right of personality is infringed, the six claims shall not be subject to limitation of action;

3.the claim for the liability for breach of contract can be simultaneously claimed for mental damage compensation;

4.the person who infringes the right of personality can apply for a ban of conduct.

5.sexual harassment is prohibited and responsibilities of government agencies, enterprises and schools are clearly defined.

2021年1月1日《民法典》实施后，现行《民法通则》、《民法总则》将被废止，人格权编自第989条至第1039条，共51条，并独立成编，体现了人的精神本性与精神追求的人文关怀，内容主要体现了对人格尊严和人格权逐渐完善的普遍尊重和全面保护。是落实十九大报告精神的具体体现，也是新时代全面保障个人人格尊严、保障人民体面生活的重要举措。

On January 1, 2021 since the implementation of "civil code" the present "general principles of the civil law", "the general civil law" will be repealed, personality right from article 989 to article 1039, article 51, and separate into knitting, embodies the spirit of nature and spirit pursuit of humanistic care, mainly embodies the respect for perfecting personality dignity and the personality right of universal and comprehensive protection. It is a concrete manifestation of the spirit of the report of the 19th National Congress, and an important measure to fully guarantee the personal dignity of individuals and ensure a decent life for the people in the new era.
