【云德讲堂】云德法学家大讲堂预告 ┃赵建民法官在线讲解《九民纪要》

2019年9月11日《全国法院民商事审判工作会议纪要》（以下简称《九民纪要》）经最高人民法院审判委员会民事行政专业委员会第319次会议原则通过。《九民纪要》的出台，对统一裁判思路，规范法官自由裁量权，增强民商事审判的公开性、透明度以及可预期性，提高司法公信力具有重要意义。会议对当前民商事审判工作中的一些疑难法律问题取得了基本一致的看法。《九民纪要》发布后，人民法院对尚未审结的一审、二审案件，在裁判文书“本院认为”部分具体分析法律适用的理由时，可以根据《九民纪要》的相关规定进行说理。那么，在法律实务中如何准确理解并适用《九民纪要》？

On September 11, 2019, “The summary of the civil and commercial judicial work meeting of the national courts” was adopted in principle by the 319th meeting of the professional committee of civil administration of the judicial committee of the supreme people's court. The publication of   “The summary of the civil and commercial judicial work meeting of the national courts” is of great significance to unify the judgment thinking, standardize the discretion of judges, enhance the openness, transparency and predictability of civil and commercial trials, and improve the judicial credibility. The conference reached a consensus on some difficult legal issues in the current civil and commercial judicial work. After the publication of “The summary of the civil and commercial judicial work meeting of the national courts” , the people's court may, when analyzing the reasons for the application of the law in the "opinion of the court" part of the judgment document, make arguments in accordance with the relevant provisions of “The summary of the civil and commercial judicial work meeting of the national courts” for cases of first instance and second instance that have not been concluded by the people's court. Then, how to accurately understand and apply “The summary of nine people” in legal practice?

赵建民 法官

赵建民法官先后就读于北京大学（本科）和中国人民大学（硕士），并曾进修于美国纽约大学法学院。一直在陕西省高级人民法院从事法官培训与司法审判工作，历任陕西省法官培训中心主任、陕西省高级人民法院调研员,审判员，现为二级高级法官，西北大学兼职教授。

Judge Zhao Jianmin studied at Peking University (undergraduate) and renmin university of China (master's degree), and studied at New York University Law School. He has been engaged in judge training and judicial trial work in Shaanxi Provincial Higher People's Court, successively served as director of Shaanxi Provincial Judge Training Center, researcher and judge of Shaanxi Provincial Higher People's Court, and now he is a second-level senior judge and an adjunct professor in the Northwest University.
