【线上云德】疫情期间律师说（一）|交通运输部《关于新冠肺炎疫情防控期间免收收费公路车辆通行费的通知》之政策解读

2020年2月15日，交通运输部发布了《关于新冠肺炎疫情防控期间免收收费公路车辆通行费的通知》，提到为了更好地服务疫情防控工作，促进企业复工复产，保障经济持续健康发展，经国务院同意，决定在防疫期间免收全国收费公路车辆通行费。免收通行费的时间范围从2020年2月17日0时起，至疫情防控工作结束。个人认为 这个政策透露出两个信号：一是疫情防控仍在继续，二是湖北尤其是武汉地区以外的区域，复工已经是进行时，安全、有序复工已经是趋势，但我们各地政府、各企业、各员工对于即将到来的复工潮，都有哪些准备工作要做呢？

通过热线，西安本地的企业复工比较困难，主要是现阶段关于复工的行政审批很严格，二是复工后企业自身的安全防疫管理工作责任重大，企业管理层非常纠结。

为此我们连线了深圳某知名大型医疗器械企业的工作人员介绍了他们的复工情况：由于是医疗器械企业，相对于其他传统行业属于政府及政策倡导支持复工的行业，在行政审批难度上虽然参照性不大，但作为几千人的企企业，自2020年2月2日起至今已复工两周之多，且员工的返岗率达到百分之七十左右，在复工之后如何确保企业复工能达到疫情防控要求，能安全生产、运营方面给出了参照建议：但大规模的复工离不开员工能正常返岗这一必备要素，结合最近一段时间各地方对四类人员的劝返政策，目前西安针对疫情期间返工人员，西安市各区县、西咸新区、各开发区陆续发布公告，公布指定宾馆酒店地址、联系电话，安排返工人员在指定酒店集中居住观察，并对在指定宾馆、酒店遵照要求居住观察的人员按照50元/人·天的标准给予补助。各区县、西咸新区、各开发区将严格做好有关消杀防疫和管控工作，确保居住人员的身体健康和生活便利。而对于车辆的管控目前仍旧比较严格，绕城高速目前开放的收费站大部分仅允许西安且持西安市身份证的车辆通行，对于不符合条件的车辆、人员进行劝返。西安各区县自2020年2月8日起严控返家返工返岗返学人员，要求15天内坚决不得返回，已经返回的人员一律执行居家或集中隔离14天的规定，目前尚不清楚按照此规定15天返回西安之后是否还需要继续在家自行隔离14天，这样的政策明显与复工是相悖的，连线四川某个地级市的律师朋友时，该朋友提到当地属于劳务输出大市，但现在个别地方的人员想外出务工还必须征得村上或者社区的同意并开具证明，否则高铁等出市交通工具不能乘坐，员工都在家里无法返岗，即便政府同意企业复工，企业也只能是窝工状态，疫情防控和安全、有序复工复产如何有效协调，政策如何协调统一已经摆到了我们面前，除了湖北武汉等个别疫情重灾区之外，全国其他地区有关疫情防控和复工复产的政策协调已经刻不容缓。
