【线上云德】疫情期间律师说（一百四十七）┃道路建造、设计缺陷导致交通事故谁来承担赔偿责任？

随着我国机动车数量的快速增长，道路通车里程逐年增长，交通事故也随之频发。其中，道路安全系数不达标、路面交通安全标志不全等到道路涉及或施工缺陷，成为道路交通事故发生的重要原因。那么，因道路建造、设计缺陷导致交通事故致人损害，由谁来承担主体责任进行赔偿呢？

Then, because of road construction, design defect causes traffic accident to cause person damage, who should assume main body responsibility to undertake compensation?

《最高人民法院关于审理道路交通事故损害赔偿案件适用法律若干问题的解释》第十一条规定：未按照法律、法规、规章或者国家标准、行业标准、地方标准的强制性规定设计、施工，致使道路存在缺陷并造成交通事故，当事人请求建设单位与施工单位承担相应赔偿责任的，人民法院应予支持。为了保护被侵权人的利益，本条规定由建设单位与施工单位在相应的赔偿责任范围内承担连带责任。

同时，关于此情形，对于建设单位及施工单位而言承担的是无过错责任原则，即被侵权人只需证明道路建造、设计缺陷导致其损害，无论建设单位、施工单位对此是否存在过错，均应承担相应民事责任。建设单位和施工单位在承担了赔偿责任后，有权向其他责任人追偿。

At the same time, in this case, the construction unit and construction unit bear the principle of no-fault liability, that is, the infringed only needs to prove the damage caused by the road construction and design defects, no matter whether the construction unit and construction unit are at fault, they shall bear the corresponding civil liability.
