Public roads are related to public safety. Due to their high frequency of use, the number of passing vehicles and their fast speed, once obstacles appear on the road, accidents such as rear-end collision, collision and rolled-over are likely to occur, resulting in casualties, property losses and public safety jams. A number of laws and regulations, including the Highway Safety Law and the Road Traffic Safety Law, also explicitly prohibit the stacking, dumping and scattering of obstructing articles on the road.
Article 89 of the Tort Liability Law stipulates that if the articles piled, dumped or left behind on a public road cause damage to others, the unit or individual shall bear the tort liability, including the person who obstructs the passage by stacking, dumping or leaving behind on the road, as well as the road administrator. Therefore, in order to ensure the good applicable state of public roads, the managers and maintainers of public roads should find out the obstructing conditions and take reasonable measures in time. For example, identify and clear roadblocks in a timely manner. If the administrator or maintainer fails to fulfill the obligations of cleaning, protection and warning in accordance with laws, regulations, rules, national standards, industrial standards or local standards, the presumption of fault liability shall apply, and the road administrator shall bear the corresponding liability for compensation.
