【线上云德】疫情期间律师说（六十七）|遭遇交通事故，现场如何应对？

在日常生活中，交通事故的发生是非常频繁的，且随着私人汽车拥有量的不断上升，交通事故发生的几率也随之升高。依据陕西省统计局发布的《2019年陕西统计年鉴》显示，2018年全年陕西省内共发生了5816起交通事故，造成人员死亡1452例，人员受伤5860例，财产损失超4465万元。以上损失的发生，不仅仅是因为事故本身所造成的，还有部分是因为事故当事人不懂得事故发生后该如何处理而造成的扩大的损失。那么今天就跟大家讲解一下，遭遇交通事故后现场应该如何应对的法律问题。

A total of5,816 traffic accidents occurred in shaanxi province in 2018, resulting in1,452 deaths, 5,860 injuries and more than 44.65 million property losses,according to the shaanxi statistical yearbook 2019 released by the shaanxiprovincial bureau of statistics. The above losses occurred not only because ofthe accident itself, but also partly because the parties to the accident didnot know how to deal with the accident after the occurrence of the extendedlosses. So today, I'm going to explain to you how to deal with the legal issueson the scene after a traffic accident.

1.停车确认受害者状况。事故发生后，肇事者应立即停车，并下车返回肇事地点，确认被害者和被撞车辆的状况。

2.救护被害者。当事故引起伤、亡时，应立即采取救护措施，必要时应立即送附近医院检查抢救。

3.保护发生事故的现场。除抢救伤者外，其他现场车辆应保持发生事故后的原样，必须移动时应标明位置，便于交通事故处理机关人员勘查现场，查明事故真实情况。

2. Rescue the victim. When the accidentcauses injury, death, should immediately take rescue measures, if necessary,should immediately sent to the nearby hospital for examination and rescue.

3. Protect the scene of the accident. Inaddition to the rescue of the injured, other vehicles on the scene should keepthe original after the accident, must be moved when the location should bemarked, facilitate the traffic accident handling organs personnel survey thescene, to find out the real situation of the accident.

4.迅速报告公安机关或者执勤的交通警察。在采取上述各项措施后，还必须立即向就近的公安机关和交通警察报告。肇事者可采用电话或委托他人的方式的报告。一般情况下，在事故处理机关的人员到达之前，肇事者不应随意离开。

5.收集必要的证据。交通事故发生后，在事故处理人员到达之前，肇事者应注意收集以下证据：一是受害者的住址、姓名、车辆号码;二是现场情况;三是目击者的住址、姓名及所见情况;四是当事人双方有无过失及其程度，对方的意见等。

6.通知保险公司。机动车一般都投有保险，事故发生后，要记得通知保险公司，第一时间备案，方便保险公司的勘测和定损，以免以后理赔出现麻烦。

4. Promptly report to the public securityorgan or the traffic police on duty. 5. Gather the necessary evidence.
