侵权责任编是基于《侵权责任法》，为保护民事主体的合法权益，明确侵权责任，预防并制裁侵权行为，促进社会和谐稳定而制定。其中规定了如下亮点：

2、精神损害赔偿范围扩大

民法典扩大了精神损害赔偿范围；知识产权可主张惩罚性赔偿

精神损害赔偿适用的范围越来越广，强调了精神权益、人格权益的重要性。
