【云德活动】西安碑林法院、西安民间金融协会、西仲金融仲裁院携手云德律所开展律师调解员培训工作

为积极贯彻落实最高人民法院、司法部《关于开展律师调解试点工作的意见》和陕西省高级人民法院、陕西省司法厅联合印发《关于开展律师调解试点工作实施方案》相关文件精神，碑林法院同民间金融协会与西仲金融仲裁院合作，云德律所金融调解团受委托参与碑林区人民法院诉前调解过程，共同防范化解金融风险，服务经济健康发展。

为进一步推动调解工作的顺利开展，完善诉调衔接机制，2020年7月24日，碑林法院立案庭副庭长马军、立案庭法官习小玲、法官助理郑毅、西安民间金融协会王西省会长、常西岭理事长、邓立靖秘书长等一行莅临云德律所，为本所五十多名金融调解员开展案件调解注意事项及调解平台操作流程的讲座。

At the same time, Hu Xiaoqing starts with a speech on the significance and importance of pre-litigation mediation, the advantages of lawyer mediation in dispute resolution, continuous improvement of his own professional skills through case mediation, and the courage to shoulder social responsibilities.

西安仲裁委员会金融仲裁院常西岭理事长代表“一会一院一中心”对碑林法院此次培训活动表示衷心的感谢，金融调解中心至今已经处理碑林法院委托的案件二千多起，初步起到了良好效果，希望通过此次培训提高调解工作技能，解决调解中存在的问题，进一步推动调解工作的开展，体现调解的真正价值。

欢迎仪式之后，碑林法院立案庭副庭长马军表示，碑林法院案件数量较多，引入律师参与诉前案件调解工作，是实现审判资源的优化配置，有效应对案件急速增长、提高司法效率，化解金融合同纠纷的有力举措。希望通过此次培训提高律师调解技能，切实维护人民群众自身的合法权益，为以后的案件调解能够发挥更大的力量，为我国司法进程的不断进步完善尽一份力量。

在正式培训环节，首先习小玲法官对诉前调解过程中普遍出现的问题，需要注意的有关事项，法院对调解协议司法确认有关程序规定为大家进行了详细说明，使每位调解员认识到律师调解跟法院对接的完整程序；其次，马军副庭长以房贷、车贷、信用卡为重点，为大家讲解在金融纠纷案件调解中大家需要注意的事项，避免出现调解协议无效、瑕疵、不具有可执行性等问题；培训最后，调解软件技术支持人员胡梦瑶就碑林法院开通的线上调解软件如何使用、具体操作流程给大家进行了详细的讲解。

In the formal training, First of all, Judge Xi Xiaoling gave a detailed explanation on the common problems and matters that need attention in the mediation process before litigation. The court made a detailed explanation on the relevant procedures for judicial confirmation of the mediation agreement, so that each mediator could realize the complete procedure for lawyer's mediation to connect with the court. Secondly, Vice President Ma Jun, focusing on mortgage loan, auto loan and credit card, explained the matters that should be paid attention to in the mediation of financial dispute cases to avoid the invalidity, flaws and non-enforceability of the mediation agreement. At the end of the training, Hu Mengyao, a technical support staff of the mediation software, explained in detail how to use and the specific operation process of the online mediation software opened by Beilin Court.

培训结束之后，与会人员畅所欲言，各抒己见，就案件调解过程中遇见的各类程序或者软件问题进行了深入交流，询问解决方法，为进一步完善工作流程，顺利完成案件调解工作打下坚实基础。

After the training, the participants spoke freely, expressed their views, had an in-depth exchange of various procedures or software problems encountered in the mediation process, and inquired about solutions, which laid a solid foundation for further improving the work process and successfully completing the mediation work.
