【云德资讯】迎新春，西北大学法学院师生与校外实务导师见面会暨精彩实践课堂

    1月9日星期四下午，在这个辞旧迎新的好日子里，陕西云德律师事务所成功举办了我所校外实务导师与西北大学学子的师生见面会。与会人员有：陕西云德律师事务所创始人、云德党总支书记、主任丁云波；云德律所执行主任、涉外法律事务部首席律师胡小青；云德律所律师学院院长、法律顾问中心首席律师荆孟强；云德律所工会主席，金融投资法律事务部首席律师宋路凯；云德律所财税法律事务部首席律师，陕西省财税法学会理事尹茜；刑事辩护法律事务部律师冯雪。西北大学法学院研究生教务办专硕秘书杜佳音老师，学生胥泽斌、苗露露、韩欣谕、王亚峰、郭继星、何可人、樊一锟、陈子鑫、王苗圃、许孟强、于淼、聂鑫、翟新雅、赵铭铭、郭皓圆、周妙妙。

The participants were: Ding Yunbo, founder of Shaanxi Yunde Law Firm, secretary and director of Yunde Party General Branch; Hu Xiaoqing, Executive Director of Yunde Law Firm and Chief Lawyer of Foreign Legal Affairs Department; Jing Mengqiang, Dean of the Bar College of Yunde Law Firm and Chief Lawyer of the Legal Advisory Center; Song Lukai, Chairman of the Trade Union of Yunde Law Firm and Chief Lawyer of the Financial Investment Legal Affairs Department; Yin Qian, Chief Lawyer of the Finance and Taxation Law Department of Yunde Law Firm, Director of Shaanxi Finance and Taxation Law Society; Feng Xue, lawyer of the Criminal Defense Legal Affairs Department. Teacher Du Jiayin, Secretary of the Postgraduate Academic Affairs Office of Northwestern University Law School, and students Xu Zebin, Miao Lulu, Han Xinyu, Wang Yafeng, Guo Jixing, He Keren, Fan Yikun, Chen Zixin, Wang Nursery, Xu Mengqiang, Yu Miao, Nie Xin, Zhai Xinya, Zhao Mingming, Guo Haoyuan and Zhou Miaomiao.

    从被西北大学聘任至今，云德律所的各位实务导师在指导学生方面都是尽其所能，无论是辩论赛还是论坛，云德律所都在用自己的方式为构建法治人才培养共同体贡献力量。为进一步提高各位学子的实务能力，特举办本次见面会，为2020年的新篇章拉开序幕。

    Since being employed by Northwestern University, all the practical instructors of Yunde Law Firm have done their best to guide students. Whether it is debating competitions or forums, Yunde Law Firm is contributing to the construction of a community of legal talents training in its own way. In order to further improve the practical ability of all students, this meeting is specially held to kick off a new chapter in 2020.

    活动伊始，首先由云德律所主任丁云波律师致辞，丁云波主任从2020年的新型教学方式开始介绍，一是导师前往高校，二是通过学子到律所参加培训、旁听模拟法庭，第二种教学也会通过网络直播对所有学子全程开放。之后对各位学子的行为方式与实务考核均作出了要求，毕竟法学本身就是特别耗费时间精力的，应用型知识更是如此，而云德律所提供的实务教育就是要帮助学子们在学校的理论基础以外，学习法律在实际应用中的方式方法，为之后走入法律共同体打下良好的基础。丁云波主任还向各位学子传达了云德律所的理念，即“受人之托，忠人之事”，使学子们清楚了解本次应用型人才培养的方向。

After all, law itself is particularly time-consuming and energy-consuming, especially for applied knowledge. The practical education provided by Yunde Law Firm is to help students learn ways and means of law in practical application in addition to the theoretical basis of the school, so as to lay a good foundation for entering the legal community later. Director Ding Yunbo also conveyed the concept of Yunde Law Firm to all students, that is, "be loyal to your trust", so that students can clearly understand the direction of this applied talent training.

    之后由曾经也是西大学子，如今是云德律所执行主任的胡小青律师致辞，胡小青律师就2016年以来，西北大学与云德律所从多个领域展开密切深入合作，包括共建法律教学实验基地、“云德杯”西北大学第十三届激扬青春辩论赛、“仰鸿儒之道 话管理之术”律所管理论坛等，到2019年，双方签署了《全面合作协议书》《订单人才培养协议书》及《卓越法治人才实践教学基地协议》，旨在培养卓越法治人才展开全面合作。同时，作为实务导师之一，胡小青律师坦言肩上的责任重大，后期也会继续践行实务导师的责任，也表达了对各位西大学子能够多沟通、多交流，“利用”好云德的青训体系，真正提升自己的专业素养的希望。

At the same time, as one of the practical instructors, Lawyer Hu Xiaoqing frankly admitted that he has a great responsibility on his shoulders and will continue to carry out the responsibility of practical instructors in the later period. He also expressed his hope that all Western University students can communicate more and communicate more, "make good use of" Yunde's youth training system, and truly improve their professional quality.

    师者，所以传道授业解惑也，云德律所有幸请到了西北大学的杜佳音老师参加此次见面会。杜佳音老师从十八届四中全会通过的《关于全面推成进依法治国若干重大问题的决定》谈起，谈到法治已经成为我国长期内的治国之策，法律人能够更加多的、深入的参与公共事务,在肯定了云德律所各位实务导师经验学识的同时，也对西大学子做出了鞭策：法学生变成法律人的过程不能只是看到社会美好的一面,更要看到社会中存在矛盾和纠纷的一面，而我们做的就是化解矛盾、解决纠纷。最后，杜佳音老师引用美国大法官霍姆斯的名言“法律的生命不在于逻辑而在于经验”，表达了他对2020年双方在法律实务上深度合作的期许。

Teacher Du Jiayin started from the "Decision on Several Major Issues Concerning the Comprehensive Promotion of Ruling the Country by Law" passed by the Fourth Plenary Session of the 18th Central Committee. Speaking of the fact that the rule of law has become our country's long-term policy of governing the country, Legal persons can participate more and more deeply in public affairs. While affirming the experience and knowledge of the practical instructors of Yunde Law Firm, it also urged the students of Western University: the process of law students becoming legal persons should not only see the good side of society, but also the side of contradictions and disputes in society. What we do is to resolve contradictions and disputes. Finally, Mr. Du Jiayin quoted US Justice Holmes's famous saying that "the life of law lies not in logic but in experience", expressing his expectation for in-depth cooperation in legal practice between the two sides in 2020.

    听完了老师的期许，西大学子聂鑫也代表了参会的各位同学表达了从学生角度对实务训练的期盼与未来的职业规划，清楚地认识到在研究生生涯中理论的学习还不够，仍需要与实务的对接，并且以足够量的实务经验推动自己法律应用水平质的进步。无论是加强理论知识学习，夯实基础还是将认识落实到实践中去，提升自己的逻辑思维能力、沟通协调能力等技能都是同等的重要。同时，聂鑫同学也表达了她作为西北大学的学生，很愿意积极投身于每一次的实务学习当中，推动云德律所和西大法学院的合作共赢。

    After listening to the teacher's expectation, Nie Xin, a student of Western University, also expressed her expectation for practical training and future career planning from the perspective of students on behalf of all the students attending the meeting.She clearly realized that the theoretical study in her postgraduate career was not enough, and she still needed to connect with practice, and to promote the qualitative progress of her legal application level with sufficient practical experience. Whether it is to strengthen the study of theoretical knowledge, consolidate the foundation or put knowledge into practice, it is equally important to improve one's logical thinking ability, communication and coordination ability and other skills. At the same time, Nie Xin also expressed that as a student of Northwestern University, she is willing to actively participate in every practical study and promote win-win cooperation between Yunde Law Firm and Law School of Western University.

    实务导师荆孟强律师就本次见面会给各位学子分享了作为实务导师如何进行价值体现，方法主要有四个：第一是传统的线下授课，即法律实务教学进课堂比如以案说法。第二是职业规划，让各位学子充分感受到法律实务行业的现状，有助于学子们在毕业时能做出有效的选择。第三是实务操作，要增加各位学子在实务操作方面的训练量，从办案思路、材料准备等方面有针对性的提供指导。第四就是互联网的线上授课交流，完美解决了物理地域的问题，可以从律所的公众号或者直播来参与学习。

    Lawyer Jing Mengqiang, a practical instructor, shared with the students how to embody the value as a practical instructor. There are mainly four methods: the first is the traditional offline teaching, that is, legal practical teaching is introduced into the classroom, for example, ues case to explain it. The second is career planning, which enables students to fully feel the current situation of the legal practice industry and helps students to make effective choices when they graduate. The third is practical operation. We should increase the training amount of students in practical operation and provide targeted guidance from the aspects of case handling ideas and material preparation. The fourth is the online teaching and communication on the Internet, which perfectly solves the problem of physical region and can participate in the learning from the public number or live broadcast of the law firm.

    在几位实务导师的发言之后，自由交流的过程中，西大学子就学习过程中产生的问题向实务导师请教，其中不乏对于实体、程序、证据链条、非诉等实务的探讨，学子们积极请教、导师们热情回答，解决实务问题的同时，也进一步拉近了导师和学子之间的关系。
