【云德资讯】树立法治能源理念 推动能源法律治理|云德律师参加省法学会能源法学研究会2019年会并深度解读能源法律治理实践新发展

    12月29日，陕西省法学会能源法学研究会2019年年会在西安交通大学法学院举行。本次年会以“能源转型中的法律治理理论与实践”为主题，来自理论界、实务界、能源企业界大咖们齐聚一堂，共话能源法律规制前景，云德律所律师作为能源法学研究会常务理事、理事应邀参会。

    On December 29, the 2019 Annual Meeting of the Energy Law Research Association of Shaanxi Law Society was held in the Law School of Xi'an Jiaotong University. The theme of this annual meeting is "Theory and Practice of Legal Governance in Energy Transformation". Major players from the theoretical, practical and energy business circles gathered together to talk about the prospect of energy legal regulation. Lawyers from Yunde Law Firm were invited to attend as executive directors and directors of the Energy Law Research Association.

    年会现场，由来自西安交大、重庆大学、西北政法大学、西北大学等研究能源领域的理论界权威作了主题报告，报告主要从水电开发乱象严重、生态政治与治理、一带一路战略层面能源经济法律规制以及能源合作制度建构理念等方面进行了深度探讨与交流。

    On the spot of the annual meeting, The theme report was made by theoretical authorities from Xi'an Jiaotong University, Chongqing University, Northwest University of Politics and Law, Northwest University of Politics and Law and other energy research fields. The report mainly discusses and exchanges in depth from the aspects of serious chaos in hydropower development, ecological politics and governance, legal regulation of energy economy at the strategic level of the Belt and Road, and the concept of energy cooperation system construction.

    在与谈环节，能源法学研究会常务理事、云德律所主任丁云波作为实务界代表对新时代我国能源转型的法治挑战与因应等主题报告进行了现场点评，提出针对目前世界上GDP位列前几名的国家比如英国、法国、德国等都有能源基本法，而我们国家能源立法本身起步比较晚的现状，希望在国家层面能对能源领域的制度性予以凸显和重视，呼吁能源领域能够有“母法”的规制和调整。同时认为能源转型也需要法律制度转型，律师在对能源方面法律实施需求更加迫切，尤其近年来，我国在能源领域腐败案件频出，也比较严重，也与能源法治不彰、“公权力无法律明文规定不可为”的法治原则不能很好贯彻不无关系。

    In the conversation, Ding Yunbo, executive director of the Energy Law Research Association and director of Yunde Law Firm, as a representative of the practical circle, made on-site comments on the thematic reports on the legal challenges and responses of China's energy transformation in the new era. It is pointed out that in view of the fact that countries with the highest GDP in the world, such as Britain, France and Germany, all have basic energy laws, while our country's energy legislation itself started relatively late, it is hoped that the system in the energy field can be highlighted and valued at the national level, and it is called for the regulation and adjustment of "mother laws" in the energy field. At the same time, it is believed that the transformation of energy also requires the transformation of legal system, and lawyers' demand for the implementation of laws on energy is more urgent. Especially in recent years, corruption cases in the field of energy in our country are frequent and relatively serious, which is also related to the weak rule of law in energy and the failure to implement the rule of law principle of "public power cannot be done without legal provisions".

    最后丁云波主任表示，十九届四中全会决定里明确提出要坚持和完善生态文明制度体系，落实最严格的生态环境保护制度，全面建立资源高效利用制度，健全生态保护和修复制度，严明生态环境保护责任制度，确保到2035年生态环境质量实现根本好转，生态环境领域国家治理体系和治理能力现代化基本实现，美丽中国目标基本实现。所以，目前我们不管从理论界、实务界还是能源技术引领方面都亟需树立法治能源理念，以保证能源安全、高效和可持续供给。

    Finally, Director Ding Yunbo said, The decision of the Fourth Plenary Session of the 19th Central Committee clearly stated that we should adhere to and improve the system of ecological civilization system. We will implement the strictest ecological environment protection system, comprehensively establish a system for efficient utilization of resources, improve the ecological protection and restoration system, and strictly enforce the responsibility system for ecological environment protection, so as to ensure that by 2035 the quality of the ecological environment will be fundamentally improved, the modernization of the national governance system and governance capability in the field of ecological environment will be basically realized, and the goal of a beautiful China will be basically realized. Therefore, at present, we urgently need to establish the concept of legal energy in terms of theory, practice and energy technology guidance to ensure safe, efficient and sustainable energy supply.
